General terms and conditions of business

1. Scope

  1. These General Terms and Conditions apply to contracts for the rental of hotel rooms, apartments, event spaces, and all other services and deliveries provided by the Hotel Albergo Toscana & Villa Bohemia, Rudolf-Sendig-Straße 17, 01814 Bad Schandau, Tel.: 49 (0) 35022 91671, E-Mail info@albergo-toscana.de (hereinafter referred to as "we" or "Hotel") and customers, who may be both consumers and entrepreneurs (hereinafter collectively referred to as "Guest" or "Customer").
  2. The contracting parties are the hotel and the booking guest.
  3. By making a booking, the guest accepts these terms and conditions.
  4. Any differing terms and conditions of the guest shall only apply if they have been expressly agreed to in writing.

2. Contract Conclusion & Booking

  1. The contract is concluded upon acceptance of the booking by the hotel.
  2. Bookings can be made by telephone, email, via the hotel's own website or via external booking platforms.
  3. For online bookings, the contract is concluded by clicking the "book with obligation to pay" button.
  4. The hotel reserves the right to refuse bookings for objectively justified reasons.
  5. Subletting or further letting of the provided rooms or premises requires the prior written consent of the hotel.

3. Prices & Payment Terms

  1. The prices quoted at the time of booking apply.
  2. All prices include the applicable statutory value added tax.
  3. The local tourist tax is not included, provided it is shown separately.
  4. For room reservations, payment can be made online via debit card, credit card or PayPal, as well as on-site in cash.
  5. Vouchers can be paid for by bank transfer, credit card or PayPal.
  6. The hotel is entitled to demand a reasonable advance payment or security deposit upon conclusion of the contract.
  7. Invoices without a separate due date are payable within ten days of receipt of the invoice without deduction.
  8. In case of late payment, the statutory regulations apply.

4. Vouchers

  1. Vouchers can be purchased via the DIRS21 voucher shop.
  2. Gift vouchers and breakfast vouchers are offered.
  3. Vouchers can be sent either free of charge via email or by post for a shipping surcharge of €3.00.
  4. Vouchers are valid until the end of the third year after the date of purchase. The specific expiry date is printed on the voucher.
  5. Cash payment of vouchers or remaining balances is excluded.

5. Arrival & Departure

  1. The rooms are available from 3:00 PM on the day of arrival.
  2. On the day of departure, we kindly ask our guests to vacate their rooms by 10:00 am at the latest.
  3. Late arrivals must be registered in advance by 5:00 PM at the latest.
  4. For late arrivals, the guest will receive the access data for the key box on the day of arrival.
  5. A late check-out is only possible by prior arrangement and subject to availability.

6. Extra beds & children

  1. Children aged 0 to 2 years inclusive stay free of charge in their parents' bed.
  2. A baby cot can be provided on request for a one-time fee of €10.00.
  3. For children aged 3 to 11 years inclusive, we charge €20.00 per night and child.
  4. For young people aged 12 and over, as well as additional adults, we charge €30.00 per night and person.

7. Dogs

  1. Dogs are only allowed in selected rooms and only after prior registration.
  2. The fee is €15.00 per animal per night.
  3. Only one pet is allowed per room.
  4. Guests are liable for any damage or extraordinary cleaning costs caused by animals they bring with them.
  5. In case of exceptional soiling of the room, the hotel reserves the right to charge a cleaning fee of €100.00.
  6. Dogs must not be left unattended in the hotel area and are not allowed in the breakfast room.

8. Breakfast reservations & catering services

  1. Breakfast can also be reserved by external guests, subject to availability.
  2. Free cancellation of breakfast reservations is possible up to 24 hours before the reserved date.
  3. In case of later cancellation or non-utilization, the hotel reserves the right to charge 100% of the agreed price.
  4. Catering services that have been predefined and ordered, or are part of a package, will be charged according to the following criteria:
  5. Free cancellation is possible up to 14 days before arrival.
  6. For cancellations between 13 and 7 days before arrival, 60% of the agreed total price will be charged.
  7. For cancellations made between 6 and 2 days before arrival, 80% of the total price will be charged.
  8. From 1 day before arrival or in case of no-show, 100% of the total price will be charged.
  9. The guest retains the right to prove that the hotel suffered no damage or significantly less damage.

9. Cancellation Policy

  1. Individual bookings up to 3 rooms
  2. Free cancellation is possible up to 14 days before arrival.
  3. For cancellations between 13 and 7 days before arrival, 60% of the total amount will be charged.
  4. For cancellations made between 6 and 2 days before arrival, 80% of the total amount will be charged.
  5. From 1 day before arrival or in case of no-show, 100% of the total amount will be charged.
  6. The decisive factor is 6:00 PM on the respective day.
  7. Group bookings from 4 rooms
  8. Bookings for 4 to 8 rooms
  9. For cancellations up to 6 weeks before arrival, 50% of the total amount will be charged.
  10. Up to 3 weeks before arrival, 80% of the total amount will be charged.
  11. Then 100% of the total amount will be calculated.
  12. The decisive factor is 6:00 PM on the respective day.
  13. Bookings for 9 rooms or more
  14. For cancellations up to 8 weeks before arrival, 50% of the total amount will be charged.
  15. Up to 4 weeks before arrival, 80% of the total amount will be charged.
  16. Then 100% of the total amount will be calculated.
  17. The decisive factor is 6:00 PM on the respective day.
  18. The guest retains the right to prove that the hotel suffered no damage or significantly less damage.
  19. To avoid unnecessary costs, we recommend taking out travel cancellation insurance.

10. Events, Groups & Retreats

  1. Separate agreements may apply for events, group tours, retreats or exclusive bookings.
  2. The hotel or individual areas of the building can be rented for private or business events by prior arrangement.
  3. Bringing your own food and drinks requires the prior approval of the hotel.
  4. Changes in the number of participants or the scope of the event should be communicated to the hotel in good time.
  5. The hotel reserves the right to cancel events or withdraw from the contract for objectively justified reasons.

11. Bicycles, e-bikes & parking spaces

  1. A bicycle storage room is available for bicycles and e-bikes.
  2. E-bikes can be charged there.
  3. The hotel is liable for loss, theft or damage to bicycles, e-bikes or accessories only within the framework of the statutory provisions.
  4. Parking spaces are available to guests subject to availability and at an additional cost. There is no entitlement to a specific parking space. The provision of a parking space does not constitute a safekeeping agreement.

12. Smoking ban

  1. A bicycle storage room is available for bicycles and e-bikes.
  2. E-bikes can be charged there.
  3. The hotel is liable for loss, theft or damage to bicycles, e-bikes or accessories only within the framework of the statutory provisions.
  4. Parking spaces are available to guests subject to availability and at an additional cost. There is no entitlement to a specific parking space. The provision of a parking space does not constitute a safekeeping agreement.

13. Liability

  1. The hotel is liable without limitation for damages resulting from injury to life, body or health.
  2. The hotel is only liable for other damages in cases of intent or gross negligence.
  3. The hotel is liable for items, bicycles, vehicles or valuables brought onto the premises only within the framework of the statutory regulations.
  4. Should any disruptions or defects occur, the hotel will endeavor to remedy the situation as quickly as possible.
  5. Guests are obliged to report any recognizable defects immediately.

14. Data protection

  1. Information on the processing of personal data can be found in our privacy policy on our website.

15. Final Provisions

  1. Any changes or additions to these terms and conditions must be in writing.
  2. German law applies.
  3. The place of jurisdiction is – insofar as legally permissible – Pirna.
  4. Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
